2. Sources and categories of processed personal data

1.The controller processes the personal data you have provided to it or the personal data that the controller has obtained on the basis of fulfilling your order.

2.The controller processes your identification and contact data and the data necessary for the performance of the contract.

3.If you give consent on the website under Article 3(4), the controller also processes online identifiers (in particular your IP address and identifiers from cookies) and data on your use of the website (pages visited, clicks, submission of the contact form, device and browser data, and session recording).

3. Legal basis and purpose of processing personal data

1.The legal basis for processing personal data is

  • performance of the contract between you and the controller pursuant to Article 6(1)(b) of the GDPR,
  • the legitimate interest of the controller in providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6
  • your consent to processing for the purposes of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no order for goods or services has been placed.
  • your consent to traffic measurement and advertising pursuant to Article 6(1)(a) of the GDPR in conjunction with Section 89(3) of Czech Act No. 127/2005 Coll., on Electronic Communications,
  • the legitimate interest of the controller in a functional website pursuant to Article 6(1)(f) of the GDPR, for the data described in Article 3(6).

2.The purpose of processing personal data is

  • the processing of your order and the exercise of rights and obligations arising from the contractual relationship between you and the controller; when placing an order, personal data that are necessary for the successful processing of the order are required (name and address, contact), the provision of personal data is a necessary requirement for the conclusion and performance of the contract, without the provision of personal data it is not possible to conclude the contract or for the controller to perform it,
  • sending commercial communications and carrying out other marketing activities.
  • measuring traffic and use of the website, including session recording, so that the controller can improve the website (only with your consent),
  • advertising the controller's services in Google and Meta systems, including conversion measurement and remarketing (only with your consent).

3.On the part of the controller there is automated individual decision-making within the meaning of Article 22 of the GDPR. You have given your explicit consent to such processing.

4.The traffic measurement and advertising tools listed in paragraph 5 start only after you choose “Accept” in the bar on the website. This choice applies jointly to measurement and advertising. Consent is voluntary: if you choose “Decline”, none of these tools start and you can keep using the website. The website remembers your choice for 6 months and then asks again.

5.After you give consent, the website uses these tools:

  • PostHog (PostHog, Inc., USA): traffic measurement, automatic event capture and session recording. It sets the ph_*_posthog cookie (1 year) and stores data in the browser's localStorage and sessionStorage. If you send the contact form, the email you give in it is linked to the usage data in PostHog.
  • Google Analytics (Google Ireland Limited): traffic measurement. It sets the _ga and _ga_* cookies (2 years). Under its terms, Google describes itself as a processor for this service.
  • Google Tag Manager (Google Ireland Limited): loads the other Google and Meta tools on the website.
  • Google Ads (Google Ireland Limited): conversion measurement and remarketing. It sets the _gcl_au cookie (90 days), stores _gcl_ls in localStorage, and Google may set further cookies on its own domains, such as doubleclick.net. Google may act as an independent controller for this service.
  • Meta Pixel (Meta Platforms Ireland Limited): conversion measurement and advertising. It sets the _fbp and _fbc cookies, and Meta may set further cookies on its own domains, such as facebook.com. Under Meta's terms, the controller and Meta Platforms Ireland Limited are joint controllers under Article 26 of the GDPR for event data on the website whose purposes they determine together; once Meta has received that data, it is an independent controller.

6.Without consent, the website stores in your browser only what it needs to work: the saimon_consent cookie (your choice and the version of the bar text, 6 months), the locale cookie (selected language, 1 year) and content_* items in localStorage (website content).

7.You can withdraw consent at any time: click “Cookie settings” in the website footer and choose “Decline”. This turns the tools off and removes their cookies and stored data on this website's domain from your browser. The website cannot delete cookies on Google and Meta domains; you can delete them in your browser settings. Withdrawal does not affect the lawfulness of processing before it and does not itself erase data the tools have already received; you can request its erasure using the contact details in Article 1.

4. Data retention period

1.The controller retains personal data

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
  • until consent to the processing of personal data for marketing purposes is withdrawn, no longer than 3 years, if the personal data are processed on the basis of consent.
  • for traffic measurement and advertising, cookies remain in your browser for the period stated in Article 3(5) unless consent is withdrawn sooner; data in the tools themselves is kept for the period set in the given tool.

2.After the period for retaining personal data expires, the controller will delete the personal data.

5. Recipients of personal data (subcontractors of the controller)

1.The recipients of personal data are entities

  • participating in the delivery of services on the basis of the contract,
  • providing the tools described in Article 3(5): PostHog, Inc., Google Ireland Limited and Google LLC, Meta Platforms Ireland Limited and Meta Platforms, Inc.,

  • providing marketing services.

2.When the tools described in Article 3(5) are used, personal data may be transferred to a third country (a country outside the EU), in particular to the USA. According to what the providers of these tools state:

  • Google relies on the EU-U.S. Data Privacy Framework, which is based on a European Commission adequacy decision, for transfers of personal data from the EEA to the USA; otherwise it may use standard contractual clauses: Google's information
  • Meta Platforms Ireland Limited relies on the same framework for transfers to Meta Platforms, Inc. in the USA and may also use other GDPR mechanisms, such as standard contractual clauses: Meta's information
  • This website uses PostHog's European cloud, whose data is stored in Frankfurt. In its data processing agreement, PostHog states that it may also process data outside the EU, including in the USA, and that it participates in the EU-U.S. Data Privacy Framework: data processing agreement, list of subprocessors

3.A transfer of personal data to a third country to the controller's other suppliers is permitted only under the conditions of Chapter V of the GDPR. The controller will provide information on recipients and safeguards on request using the contact details in Article 1.

2.The controller is entitled to change these terms. The controller will publish the new version of the personal data protection terms on its website.
